I got married to a woman and did not consummate the marriage with her, but I used to be in touch with her on my mobile phone, and I saw her naked through the mobile phone camera, then I divorced her before consummating the marriage with her. Does she have to observe ‘iddah and is she entitled to the mahr in full?
I put this question to our shaykh, ‘Abd ar-Rahman al-Barrak (may Allah preserve him) and he said:
The ruling on khulwah [being alone with the woman], which was mentioned by the jurists, does not come into effect as a result of this looking, because the condition of khulwah is that the man should be alone with the woman in a place in which it is possible for him to have intercourse with her. End quote.
