Can the agent of the person appointed to supervise a waqf be paid from the income of the waqf?

Question: 13040

If the person in charge of a waqf is allocated five percent – for example – and he appoints a real-estate agent to collect rents, and the real-estate agent says, “I want 2.5 % in return for collecting the rents,” then the person is charge of the waqf will take the rent money and spend it on what is needed for the waqf – should the real-estate agent be paid from the returns of the waqf or from the share of the person in charge of the waqf?.

Answer

Praise be to Allah, and peace and blessings be upon the Messenger of Allah and his family.

We put this question to Shaykh ‘Abd al-Rahmaan ibn Jibreen (may Allaah preserve him) and he answered as follows:

He should be given from the share of the person in charge of the waqf, because he is getting five percent whether he is the one who does that job or delegates it to someone else. If he delegates it to someone else, then that person is taking his place and should take some of his share.

 And Allaah knows best.
